Acceptance of Terms This web site is offered to the user of the Service (User) on the condition that the user accepts the terms contained herein, without any modification whatsoever. For the purposes of this Terms of Use, ‘Service’ shall mean and include, without limitation, access to all, one or some of the following: HTML Code, literature, information, software, products, tools and Services provided or made available on www.globalfundmedia.com whether pursuant to subscription or otherwise. 

Intellectual Property Rights (IP) Global Fund Media Ltd. hereby grants to the User, the right to use the Service in accordance with these terms, and for no other purpose. Please note that all elements contained on this web site including all individual articles, columns and other elements making up the Service are also Copyrighted works and are owned by Global Fund Media Ltd. and/or its Suppliers and are protected by Copyright, Service Marks and Trademark laws, International Treaty provisions and/or other proprietary rights under the laws of India and this Terms of Use. By using the Service you agree to abide by all applicable Copyright and other laws as well as any additional Copyright notices or restrictions contained in the Service. Global Fund Media Ltd. or other third parties shall be entitled to obtain equitable relief for any violation of their IP, over and above all other remedies available to it to protect its interests therein. Violators will be liable to be prosecuted to the maximum extent possible. Copying for reproduction, for redistribution or other purpose of the web site or any part thereof including but not limited to text content and graphics to any other server or location including caching of any kind is expressly prohibited. The Service is licensed to the User not sold to him. Global Fund Media Ltd. owns the Service, its applications and Trademarks.

The User’s use of each such site is also subject to this terms of use and other Terms of Use, if any, contained within each such site. In the event that any of the Terms contained herein conflict with the Terms of Use contained within any such site, then the Terms of use for such site shall prevail. The linked sites are not under the control of Global Fund Media Ltd. and Global Fund Media Ltd. is not responsible for the contents of any linked Site or any link contained in a linked Site, or any changes or updates to such sites. Global Fund Media Ltd. will not directly or indirectly be liable for any loss that may arise to the User as a result of his accessing the linked sites. 

Access Restriction/Fees Global Fund Media Ltd. reserves the right to deny, in its sole discretion, any User access to this web site or any portion thereof without notice or justification. Further Global Fund Media Ltd. reserves the right at any time to charge fees for access to any Service provided by it. It shall put up a notice to this effect with necessary details at the relevant point of time. 

Limits on Personal and Non-Commercial Use The User expressly agrees to use the Service strictly for personal purpose. The User shall not recompile, disassemble, copy, modify, distribute, transmit, display, perform, reproduce, publish or create derivative works from, transfer, or sell any information, software, products, tools or services accessed from this web site. User may not rent, lease, sell, sublicense, lend or in any manner allow any other party to use the Service, with or without consideration. 

Privacy The User represents that he is aware that in the process of subscribing to the Service or parts of it, Global Fund Media Ltd. may obtain information relating to the User, including that of a confidential nature. This information will be used by Global Fund Media Ltd. for its internal purposes and will be kept confidential. Notwithstanding anything contained above, Global Fund Media Ltd. reserves the right to disclose personal information where it believes in good faith that such disclosure is required by law, to perform necessary credit checks or collect or report debts owed to Global Fund Media Ltd., to protect Hedgmedia’s rights or property or for other bonafide uses. The User agrees and warrants that all information that Global Fund Media Ltd. may possess or may obtain pursuant to the use of Service has been possessed or obtained with the permission of the User. 

Modification of These Terms and Condition Global Fund Media Ltd. reserves the right to change, without notice, this Terms of Use under which the Service is offered. The User’s continued use of the Service will be subject to the Terms of Use in force at the time of the use. 

Indemnification The User agrees to indemnify, defend and hold harmless Global Fund Media Ltd., its officers, directors, employees, representatives and agents, any third party providers, distributors from and against any cause of action, claim or demand, including without limitation any reasonable legal, accounting or other professional fees, brought by or on the User’s behalf in excess of the liability described herein or by/on account of a third party due to or arising out of User’s use of this web site, the Service contained herein, the violation of any intellectual property or any other right of any person or entity. 

Disclaimer of Warranties Global Fund Media Ltd. warrants that it does not provide any investment advice on this web site. The User warrants that it shall obtain independent investment advice before taking any investment decision. Global Fund Media Ltd. expressly disclaims all warranties and conditions of any kind, whether express, implied or statutory pertaining to the Services provided by it including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose, data accuracy and completeness and any warranties relating to viruses and non-infringement in the Service and provision of Service free from disruption or interruption. Global Fund Media Ltd. does not warrant accuracy of any NAV or other feed or data received from any third party data supplier and/or any other third party and shall not be responsible for any loss or liability incurred by the User as a consequence of his or any other person on his behalf taking any investment decisions based on the information, NAV’s, analysis, quotes, etc. provided on the web site. Global Fund Media Ltd. shall not be liable, directly or indirectly, to the User or any third party, as a consequence of the failure of its equipment, howsoever defined, or that of any Stock exchange, Internet Service Provider, User or any third party to function in such manner as is reasonably expected of such equipment. Global Fund Media Ltd. shall not be responsible for any downtime of such equipment. Global Fund Media Ltd. makes no representations or warranties, either express or implied that the research, development, marketing, distribution, use or sale of the Service will not infringe any patent, copyright or other right of any third party. 

Limitation of Liability The User agrees that neither Global Fund Media Ltd. nor its directors or employees shall be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use/delivery/performance or the inability to use/deliver/perform the Service or for cost of procurement of substitute goods and repair & correction services or resulting from the Services subscribed to or obtained or messages received or transactions entered into through or of User’s transmissions or data, even if Global Fund Media Ltd. or its employees have been advised of the possibility of such damages. The User further agrees that Global Fund Media Ltd. shall not be liable for any damages arising from interruption, suspension or termination of Service, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent. The User also agrees that his sole remedy under this Terms of Use is cancellation of the Service. 

Governing Law and Jurisdiction This Terms of Use is governed by the laws of the United Kingdom and Wales. The User hereby consents and submits to the exclusive jurisdiction and venue of Courts of the United Kingdom and Wales in all disputes arising out of or relating to the use of this web site or Service. 

General Nothing contained in this Terms of Use is in derogation of Global Fund Media Ltd. right to comply with Governmental, Court and Law enforcement requests or requirements relating to the use of this web site, Service or information provided to or gathered by Global Fund Media Ltd. with respect to such use. This Terms of Use constitutes the entire agreement between the User and Global Fund Media Ltd. with respect to this web site and the Services provided by Global Fund Media Ltd.. 

Feedback Global Fund Media Ltd. reserves the right to reproduce in part or full clients’ views about its Services in its product promotions or in its communications with prospective clients. Clients who do not wish their views to be used as above may intimate Global Fund Media Ltd. in writing to this effect. 

Termination If the User violates any term of this Terms of Use, Global Fund Media Ltd. may terminate the User’s access to this web site, without waiving any other rights. The User would continue to remain liable for any liabilities that may have arisen before the termination. 

Disclaimer for Calculators Global Fund Media Ltd. does not warrant that this Service is/will be accurate, complete, current, reliable, suitable, free from any virus, disruption or interruption. Code of Conduct

This Code of Conduct (the Code) applies to anyone who engages with GFM including, but not limited to, attendance at any events, training courses, and international activities and conferences. GFM is committed to ensuring that the Code is adhered to at all times and particularly in group settings.  Please read the Code as your participation in GFM activities will be deemed as acceptance and agreement to the Code. 

Action will be taken against anyone who does not adhere to the Code, which may include a prohibition on attendance at future events regardless of membership status with GFM. 

All speakers, trainers, supporters, staff, volunteers, sponsors and delegates/attendees must behave in a courteous and respectful manner towards others at all times. They must maintain a professional demeanour and professional conduct and refrain from improper language or conduct. Professional conduct and language shall be determined in the sole reasonable judgment of GFM. Speakers, trainers, supporters, donors, staff, volunteers, sponsors and delegates/attendees must not engage in the following behaviours that are not tolerated by GFM including, but not limited to: 

  • Harassment is any improper or unwelcome conduct that might reasonably be expected or be perceived to cause offence or humiliation to another person. Harassment in any form because of offensive or discriminatory actions or comments related to a person’s sex, race, sexual orientation, disability, age, marital status, pregnancy and maternity, religion or belief, appearance or other aspects of identity or protected characteristic under the Equality Act 2010.   
  • Sexual harassment is defined under the Equality Act (2010) as “unwanted conduct of a sexual nature, which has the purpose or effect of either: (a) violating the complainant’s dignity; or (b) creating an intimidating, hostile, degrading, humiliating or offensive environment for the complainant.” Examples of sexual harassment include, but are not limited to,  sexual innuendo, comments about someone’s sexual orientation or gender identity, name-calling with a sexual connation, making sexual comments about someone’s appearance, clothing or body parts, sexual jokes and stories, displaying still or moving images or sending emails, texts or social media containing sexual content, making sexual gestures, asking for sexual favours or repeatedly asking someone for a date, unwanted touching, attempted or actual sexual assault.  

 

  • Bullying is any offensive, insulting abusive, malicious or intimidating behaviour or misuse of power that undermines, humiliates, or causes physical or emotional harm to someone. 
  • It can also be: 
  • Threats or incitements of violence against anybody. 
  • Stalking or deliberate intimidation, including continued one to one communication after a request to cease. 
  • Publication of confidential or sensitive communication. 
  • Unwelcome comments regarding another person’s lifestyle choices or practices. 
  • Excessive consumption of alcohol that mean professional boundaries and behaviours cannot be maintained. 
  • Consumption or possession of illegal drugs of any form under any circumstances. 

 

The ACAS Guide states: “Bullying might: 

  • be a regular pattern of behaviour or a one-off incident 
  • happen face-to-face, on social media, in emails or calls 
  • happen at work or in other work-related situations 
  • not always be obvious or noticed by others 
  • It’s possible someone might not know their behaviour is bullying. It can still be bullying even if they do not realise it or do not intend to bully someone” 
Delegate Terms & Conditions

These terms and conditions apply between the person, firm, company or other entity specified on your booking form (“you” or “your“) and Global Fund Media Ltd (GFM) its employees, officers and directors, that is the owner, organizer, operator and/or manager of the event/conference (“GFM“), for attendee / delegate registrations for the event specified on your booking form (“Event“). Please read them carefully as they contain important information. By submitting your registration to attend the Event (“your registration“) you agree to be bound by these terms to the exclusion of all other terms. If you do not agree to be bound by these terms Global Fund Media Ltd will be unable to accept your registration. 

 

1. Registration Confirmation 
Your registration (whether submitted directly by you or on your behalf) is an offer to Global Fund Media Ltd to attend an Event which is subject to Global Fund Media’s acceptance in writing (which may include (without limitation) email). A binding contract between GFM and you will only be formed when written confirmation of acceptance (“Confirmation” or “Confirmed“) is sent by GFM to you (whether or not it is received) using the contact details you provided at the time of registration. If you have not received Confirmation within 5 days of your registration you should contact GFM via email to [email protected]. GFM reserves the right in its sole discretion to refuse to accept your registration. 

 

2. Fees and Payment Terms 

2.1 You will pay GFM the fees specified in your booking form for the Event (“your fees“). Payment of your fees must be received in full, and in cleared funds by GFM from you in accordance with GFM’s payment terms within 15 days of receiving your invoice. If payment of your fees in full is not received before the Event, GFM may (at its sole discretion) either require such payment as a condition of your access to the Event or refuse or block your access to the Event (whether physical or virtual). No refunds of any proportion of your fees already paid (if any) will be made and any balance of your fees will remain due and payable where access to an Event is refused under this Condition 2.1. 

2.2 It is the intent of the parties that GFM will receive payment of your fees net of all applicable taxes, including without limitation, sales, VAT, service or withholding taxes (“Taxes“), all of which shall be paid solely by you. If and to the extent that any Taxes are levied upon, or found to be applicable to, the whole or any portion of the payment of your fees, the amount of such 
payment shall be increased by an amount necessary to compensate for the Taxes (including any amount necessary to “gross up” for Taxes levied on the increase itself). 

 

3. Cancellation by You 

3.1 Except as may be otherwise expressly advised as part of the particular Event’s registration process, whilst you may cancel your registration in accordance with this Condition 3, GFM regrets that the registration fee is non-refundable. Substitutions with employees from your organisation will be considered on a case-by-case basis and will be subject to GFM’s screening and approval process; substitution requests should be made via email to  [email protected] Delegate registrations are issued for the delegate’s personal use only and cannot be shared with any person during the Event. No substitutions are accepted once the registered party has accessed the pre-Event networking or partnering facilities, applications or platforms. You may not purchase registrations as agent for any third party, sell or otherwise transfer your registration to others, or exploit the registration  commercially or non-commercially in any way. 

 

4. Change to or Cancellation of the Event by GFM 

4.1 GFM may (at its sole discretion) change the format (including, without limitation, from a physical in-person Event to a virtual Event and vice versa), speakers, participants, content, venue location and programme or any other aspect of the Event at any time and for any reason, whether or not due to a Force Majeure Event, in each case without liability. 

4.2 GFM may (at its sole discretion) change the date or cancel an Event at any time for any reason. Where GFM changes the date or cancels the Event for any reason except due to a Force Majeure Event (in which case the terms of Condition 4.3 shall apply) GFM shall automatically transfer your registration to any rearranged Event that GFM chooses to organise (acting in its sole discretion). If you promptly, and not more than 21 days after being notified by GFM of the new date(s) of the Event, notify GFM in writing that you do not wish to attend the rearranged Event or if GFM elects not to rearrange the Event then you will (as your sole remedy) be entitled, at your discretion, to receive a credit note in respect of your fees received by GFM; the credit note will be valid for 12 months from the date of the original event. After expiry of the 21-day notification period set out above you will forfeit any right to a credit note.  

4.3 Where a Force Majeure Event has or may have (in GFM’s sole discretion) an adverse impact on: (i) the ability of GFM to hold the Event at the planned venue or on the planned date; or (ii) the Event generally, then GFM shall be entitled but not obliged (in its sole discretion) to either: (i) provide an alternative format, facility or venue for the Event; and/or (ii) reschedule the Event. Any of your fees received by GFM shall be applied to any rearranged or rescheduled Event held pursuant to this Condition 4.3 and you shall not be entitled to object to such rearranged or rescheduled Event or have any right to claim any compensation in respect thereof. If GFM is unable or elects not to rearrange or reschedule the Event pursuant to this Condition 4.3, then you will (as your sole remedy) be entitled, in your sole discretion, to receive either a refund or credit note in respect of your fees received by GFM. 

4.4 These terms and conditions shall equally apply in respect of any rearranged or rescheduled Event organised by GFM pursuant to Conditions 4.2 and 4.3. 

For the purpose of these terms and conditions “Force Majeure Event” means any event or circumstance arising that is beyond the reasonable control of GFM (including but not limited to governmental laws, ordinances, regulations, requisitions, restrictions, guidelines, recommendations or action, imposition of sanctions, embargo, military action, acts or threats of terrorism or war, mob, civil commotion or riot, health scares (including without limitation, epidemic and pandemic (e.g., COVID-19), whether or not new, ongoing or recurring), fire, acts of God, flood, drought, earthquake, severe weather, disaster, disruption to transportation, third party contractor/supplier failure, venue damage or cancellation, industrial dispute, strikes, labour disputes, interruption/failure of utility service, lack of commodities or supplies, accidents, nuclear, chemical or biological contamination, speaker or participant cancellation or withdrawal, or any other comparable calamity or casualty). 

4.5 To the fullest extent permitted by the applicable law, GFM shall not be liable to you for any loss, delay, damage or other liability incurred resulting from or arising in connection with the cancellation or date change of the Event howsoever arising or any venue change. You acknowledge and agree that the provisions of Conditions 4.1, 4.2 and 4.3 set out your sole remedy should the Event be changed, postponed or cancelled and all other liability of GFM is expressly excluded. 

 

5. Consequences for Breach 

5.1 By registering for and attending the Event, you agree to comply at all times with GFM’s Code of Conduct, as outlined below at clause 11. 
5.2 GFM may (at its sole discretion) refuse access to, or eject / block from the Event, any person in its absolute discretion, including (without limitation) any person who fails to comply with these terms and conditions or who in the opinion of GFM represents a security risk, nuisance or annoyance to the running of the Event. You agree to comply with all reasonable instructions issued by GFM or the venue owners or operators at the Event.  

Any person refused access to, or ejected/blocked from the Event will forfeit any right to a credit note.  

6. Consent to Official Photography and / or Recording at Events 

6.1 All unauthorised photography and / or the recording or transmitting of audio or visual material, data or information is expressly prohibited. You consent to GFM undertaking multimedia recording of the Event which may include your participation in the Event as a delegate (the “Content”) and you consent to the use by GFM of any such recording anywhere in the world and use of such Content for promotional, marketing and other purposes. You acknowledge and agree that GFM is the exclusive owner of all rights in the Content and hereby waive any and all: (a) rights in and to such Content, and (b) claims that you may have relating to or arising from the Content or its use. 

 

7. Data Privacy 

7.1 The personal information which you provide to us will be held by us on a database and where we have appropriate authorisation/justification (which may include, without limitation, express/implied consent or legitimate interests), may be shared with other companies in the GFM group and selected third parties in the UK, United States and internationally for promotional purposes. Your personal information may also be shared with government entities and regulatory authorities as required by law. Further, there may be certain areas of the Event at which your attendance is conditional on your personal information being provided to third parties which have sponsored or are managing such areas. The use that any third parties make of your personal information is outside of GFM’s control and, to the extent permitted by applicable law, we do not accept any liability in this regard.  

 

8. Limitation of Liability 

8.1 To the fullest extent permitted by the applicable law, GFM excludes: (a) all liability for loss, injury or damage to persons or property at the Event; (b) all indemnities, warranties, representations (whether express or implied); and (c) any actual or alleged indirect loss or consequential loss, any loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss, suffered by you howsoever arising. If GFM is liable to you for any reason, GFM’s total liability to you in relation to the Event (whether under these terms or conditions or otherwise) is limited to the amount of your fees received by GFM. 

 

9. Miscellaneous 

9.1 If, by reason of any Force Majeure Event, GFM is delayed in or prevented from performing any of its obligations to you under these terms and conditions or otherwise, then such delay or non- performance shall not be deemed to be a breach of these terms and conditions and no loss or damage shall be claimed by you by reason thereof. GFM’s obligations shall be suspended during the period of the delay or non-performance and GFM and you shall each use reasonable endeavours to mitigate the effect of the Force Majeure Event. The provisions of this Condition 9.1 are subject to the provision of Condition 4.3. 

9.2 GFM reserves the right to amend these terms and conditions from time to time. However, you will be subject to the terms and conditions in force at the time you submit your registration. 

9.3 No person other than you and GFM shall have the right to enforce these terms and conditions between us without the prior written agreement of you and GFM. 

10. Governing Law and Jurisdiction 

10.1 You irrevocably agree that any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation shall be governed by English Law and settled in the courts of England and Wales. 

10.2 Nothing in this Condition 10 shall prevent or restrict GFM from pursuing any action against you in any court of competent jurisdiction.

11. Code of Conduct

11.1 This Code of Conduct (the Code) applies to anyone who engages with GFM including, but not limited to, attendance at any events, training courses, and international activities and conferences. The services and premises are provided on as ‘as is’ basis, GFM makes no warranties or representations to the you or any other party regarding the services, or any other materials provided  to the maximum extent permitted by applicable law, GFM hereby disclaims all warranties and representations whether express or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose or non-infringement, and any arising out of course of dealing or usage of trade. You should consider carefully whether or not you will be able to participate in any activities or other elements offered as part of a programme relating to the Event; it is entirely your responsibility to decide whether or not such participation is appropriate to your capabilities and health. If you have any concerns about your capabilities and/or health to participate you should consult with (and follow the recommendations of) a medical professional prior to participating. If at any time during the event you feel unwell or consider that it is unsafe for you to continue, please stop immediately and seek appropriate advice. You also accept that it is entirely your responsibility to observe all health and safety requirements and instructions that you may be given. To the extent permitted by applicable law, GFM (as well as any employees and directors or other representatives of the same) excludes all liability for any loss, injury or damage whatsoever that you may suffer in connection with or arising from your participation in any activities offered as part of the programme (including, without limitation, any activities held outside of, or incidentally to, the main Event that you are attending), whether direct, indirect, consequential, special, incidental or punitive loss, injury or damage (including, without limitation, injury to persons, property damage, theft, loss of profits, loss of business, loss of opportunity, loss of goodwill, loss or corruption of data or any other type of economic loss, injury or damage) or otherwise. The limitations and exclusions in this paragraph only apply to the extent permitted by applicable law.
